Terms & Conditions
As timber is a natural product, it is subjected to variations in colour and is an integral facet of every timber floor. We point out that all samples are prepared to give as accurate an indication of the species which they represent as practically possible, but it should be clearly understood that no sample can be taken to be a colour sample of a similar range of colours unless specifically prepared and identified for a specific project. All grades of timber specified are in accordance with the manufacturers and Australian Standards requirements. Please be aware that the grading of timber flooring has recently been relaxed, and even in select-grade timber flooring, there can be some character marks, such as minor knots and veining.
MOST ADHESIVES AND COATINGS ARE CHEMICALS; IT IS POSSIBLE FOR SOME
PEOPLE TO HAVE ADVERSE REACTIONS TO THE FUMES. IT IS OUR
RECOMMENDATION THAT ACCESS TO ANY AREAS AFFECTED BY THE FUMES BE AVOIDED UNTIL THE AREA CAN BE FULLY VENTILATED WHEN ADHESIVES AND COATINGS HAVE CURED
The customer acknowledges and agrees the following services shall be supplied free of charge to the company and according to specifications contained herein:
* Power – 2 x 240-volt electrical power points with a minimum of two 20Amp Circuit Breakers shall be supplied within 20 meters of any area where work is to be conducted (Floor sanding & polishing – Concrete Grinding)
* Lighting – Full and final lighting as designed for the complete project must be fully operational before the work commencing.
* Site Completion – All windows, doors, service vents, manhole covers, and ducting will be installed, or any other void that gives access to drafts will be installed, covered, or sealed to prevent atmospheric changes and movement during the coating stages.
* Site Storage – is to be provided free of moisture from wet trades or any other source.
* Although all care is taken, it is possible that there may be some marks on the skirting and jams and, therefore, it is recommended not to put the final coat on skirting until the polishing work is complete.
* Although all care is taken, the installation of new flooring can cause damage to walls whilst manoeuvring timber as this is a form of construction – repair/cost will be subject to negotiation. Installation and polishing constitute a form of construction work, and therefore, the client should expect some dust unless the additional cost for site cleaning is stated in the quotation.
*The client acknowledges that unbreathable protection, e.g., plastic & cardboard floor protection products cannot be used to cover the floor as it will create an artificial environment, any costs for rectifications will be forwarded to the client. We recommend researching what you intend to use and contacting the manufacturer directly. You should request in writing a copy of their warranty and only purchase and use a product that clearly states in writing it is suitable for covering finished onsite timber flooring.
*The client acknowledges that they are aware that coatings age and that due to the ageing process, marks, prints, and outlines (ghosting/tattooing) may occur in some areas. It is not possible to guarantee against the appearance of prints, blemishes, outlines, oxidisation and other aesthetically undesirable blemishes, discolouration and ageing on timber flooring. Some species of timber, coating systems and locations are more prone to ghosting. We recommend reducing the possibility of an appearance by tinting windows, installing curtains, and preventing direct sunlight from hitting the floor. Research has shown that ghosting a floor after completion from the surface is possible and does not always appear as foot/boot prints. Common household & building products are frequently the cause of blemishes. If this is potentially a problem, we recommend not polishing your timber floor and installing another flooring product. We do not accept any liability and will not re-finish if “Ghosting” or other aesthetic problems are present in the future. Please select your coating system and flooring carefully.
*Stains, scratches, and other blemishes, including marks from previous floor sanders on timber flooring, may still be visible after the completion of finishing works. Not all stains or contaminates are visible prior to sanding, the removal of premonitions are not guaranteed, and any verbal advice given on per mentioned is only opinion. Not a guarantee that the pre mentioned will not be visible on completion.
*The client acknowledges that the work site is not a controlled environment. Failure to provide doors and windows with airtight seals, install manhole covers, service vents accesses and cover ducting or other accesses where the draft can create change to internal atmospheric conditions may result in less than satisfactory surface finish. Repair works shall be at the customer’s cost.
*The client acknowledges that no access will be granted to others during the application of floor coatings and the following curing period. The opening of doors, windows, or other accesses allowing air movement will be detrimental to the appearance and feel of the cured coat. Repair works shall be at the customer’s expense.
* No responsibility can be taken for damage or contamination if sub-trades are allowed access by the customer during our polishing process, and repair works shall be at the customer’s cost. Note that damage from others is not always visible on completion of the floor. Prints and other processes may not appear for some time after completion.
*It is the client’s responsibility to provide adequate protection against direct UV light hitting the floor. Direct sunlight will cause shrinkage in the floorboards and aging of coatings. We recommend that all windows are tinted prior to installation & finishing. Curtains or blinds are installed. Floor coatings are not UV stable, and timber will oxidise quickly when exposed to direct sunlight. Floor mats should be placed on the outside of entries. The placement of rugs and other items that block UV will cause shadowing.
*It is the client’s responsibility to prevent contamination on the surface of new or old timber floors prior to & after sanding and coating applications. Failure to prevent contamination from other trades and foot traffic may result in marks appearing through coating in the following months or years. This directly results from site management and not poor floor sanding or coating failure. Repair works shall be at the customer’s cost.
*We do not recommend wet mopping of timber flooring for a minimum of four weeks from the application of the final coating. We recommend that a PH Neutral cleaner be used, or coating manufactures recommend cleaner be used if available. Please refer to your Recommended Maintenance PDF, which you will receive accompanied by invoice. Using cleaning products not recommended by manufacturers will void your floor’s warranty. Builders & site managers, please pass this info on to your clients.
*Deck coatings will require ongoing maintenance coats, usually annually, depending on exposure. Full exposure to the elements or heavy use will require shorter intervals between coats. We do not warrant any decking finishes against exposure to the elements.
*Timber identification onsite is by eye and general experience, free of charge. For formal identification, we use professional, scientific services available to all clients. We recommend the use of this service to identify flooring species. For the cost of formal identification, please request a quotation. There are many variables that will change the appearance of a timber. If you require a ‘Like for Like” match, or perfect species match. Make sure you order Timber Identification Services before proceeding with quotation.
*No allowance has been made for the levelling, repairing or waterproofing of the sub-floor unless detailed in the quotation. Any such rectification shall constitute a variation. Any subfloor outside of the standard of 3 mm under a 1.5 mm straight edge is outside of our standard and will be subject to variation (variations to be agreed upon before works)
*The customer agrees that the company shall not be held responsible for any inherent defect in the sub-floor or surface, which only becomes apparent after installation, such as changes in moisture content, sub-floor ventilation, and structural instability.
*The customer acknowledges that all artificial temperature controls, such as air conditioning and sub-floor heating have been fully installed and operated prior to any materials being delivered to the site. The customer acknowledges that they are understand the use of air conditioning can shrink and cause other defects or unsightly characteristics.
*Furniture removal &/or temporary accommodation – Unless stated in the it has not been allowed for quotation and will be charged as a variation.
*We do not have a guarantee on maintenance recoats unless agreed upon separately in writing in the quotation.
Payment for works is on completion.
The contract price is valid for thirty (14) days from the date of this agreement. If works have not substantially commenced by the date specified herein, and it is not the fault of the company, the contract price shall be subject to revision by the company. The cancellation of booked work is required in writing and within 72 hours’ notice. Cancellation of work within 72 hours will incur our minimum charge of $800.00 + GST to cover costs. Any charges to return stock will also be applied, and any product orders unable to be returned will also be charged.
Any additional work specified herein shall constitute a variation agreement. The details of any additional work shall be approved in writing before that work is commenced. The company shall not be obliged to carry out any additional work that has not been approved in writing before its start.
The customer acknowledges that there is no retention to be held in relation to the work. Once the customer has moved furniture in the works, it will be deemed as accepted, and payment will be required in full as per the quotation and our terms of payment Supply-only accounts are to be paid in full before timber delivery – until paid in full all products will remain the property of Moreton’s Pty Ltd.
Acceptance of quotation is acceptance of the above terms and conditions.
